A federal court in New York ruled that the federal Food and Drug Administration had not authorized a drug for treating heartburn.
The FDA's decision to order a generic version of Nexium, marketed as Pepcid, to be sold as a "pump" rather than a cure was ruled by the court.
The FDA said the drug works by reducing acid in the stomach.
The drug, which is the same as Nexium and the same strength as Prilosec, is designed to treat gastroesophageal reflux disease and stomach ulcers. It will be sold by Teva and by Pfizer.
"Pfizer has no right to be in the shoes of the American consumer," said John DePuyder, a professor of medicine at the University of California, San Diego. "It is an easy and cheap way to obtain a drug that will help you get rid of acid in your stomach."
The decision was announced by John DePuyder, professor of medicine at the University of California, San Diego, who was a spokesman for Teva Pharmaceuticals, the manufacturer of Pepcid.
In a ruling, the court found that the FDA's approval of a generic version of the drug was not appropriate because the generic was not the same as the original drug.
Pfizer had argued that the FDA's decision to approve the generic did not mean that the generic is not safe for use.
Pfizer's patent for the generic expired in April 2016, but the patent still expires in 2017. The drug was then only available to consumers with an active ingredient other than the generic.
The ruling is the latest in a series of FDA decisions that have led to the approval of generic versions of over-the-counter pain relievers. Pfizer, for instance, has also rejected a lawsuit by people who say they took an over-the-counter version of the drug to treat pain in the form of Nexium, which treats heartburn and ulcers.
The drug, which Pfizer's patent for is owned by Teva Pharmaceuticals, is similar to the brand-name drug Nexium, which has not yet been approved by the U. S. Food and Drug Administration.
Pfizer's patent still expires in 2017.Last December, the court ruled that the drug's generic would be safe for use, even though it is not authorized for sale by the FDA.
The drug's patent has been challenged by several manufacturers and has been rejected by a coalition of pharmaceutical and consumer advocacy groups.
The Food and Drug Administration's decision has been hailed by patients and doctors, who believe that it could improve their condition and help save lives. The decision has sparked outrage among the pharmaceutical industry, especially among those who claim the FDA's approval is just a taste of what they should be experiencing.
Pfizer's patent has been challenged by several manufacturers and has been rejected by a coalition of pharmaceutical and consumer advocacy groups. The FDA has said it is reviewing the case. The agency has also said it will take up the matter further.
The FDA has already rejected an appeal from a class action suit claiming the drug has "a dangerous, potentially fatal effect on the heart," the agency said in a statement.
Pfizer and the pharmaceutical and consumer advocacy groups are fighting the case, claiming that the drug is "not safe for use," and that they were "not allowed to manufacture, sell or use this drug."
The case was brought by Pfizer and its co-payments partner, Teva Pharmaceuticals.
The plaintiffs claim that the drug's use as a painkiller could cause heartburn, a heart condition called "heartburn," which can cause serious heart-related complications. They say the same risk exists with the generic of the drug.
The court rules that the FDA's decision to approve the generic was not based on a decision made by the agency and the drug's patent.
"We have made clear to the FDA that it is not the agency's position that a drug cannot be approved by the FDA," said Dr. Joseph F. Galson, the executive director of the FDA's Center for Drug Evaluation and Research.
"As we move forward with our studies of the safety of the drug, I think it is time to act."
Last year, the FDA said that it would not allow generic drugs to be sold without a doctor's prescription.
